Sooner or later, every organization receives a complaint of workplace discrimination, harassment, or retaliation. It may be an internal complaint from a current employee who feels her supervisor is sexually harassing her. It may be a charge of discrimination from the U.S. Equal Employment Opportunity Commission filed by an unsuccessful job applicant who claims he was wrongfully denied employment because of his race. It may be a federal lawsuit brought by an employee who claims he was discharged in retaliation for opposing disability discrimination. When this happens, it is imperative that the employer investigate the complaint. Such an investigation, however, must be conducted properly, because an improper investigation can hinder the handling and defense of claims and can lead to legal liability even if the complaint being investigated was unfounded. Conducting an appropriate EEO investigation is a skill which requires knowledge and training.
