January 10, 2012: United States Department of Labor Issues New Fact Sheets on Retaliation Under Fair Labor Standards Act and Family and Medical Leave Act.
The United States Department of Labor issued Fact Sheet 77A summarizing its views on retaliation prohibitted under the Fair Labor Standards Act and Fact Sheet 77B summarizing its views on retaliation prohibitted under the Family and Medical Leave Act. These views expressed in these facts sheets are important because they reflect the position of the agency. Employers should remember, however, that ultimately the courts decide the law, and may or may not agree in specific situations with agency guidelines. Employers covered by these laws should review these new fact sheets carefully and ensure their personnel policies and practices are consistent with the guidance provided in them. All employers should have a written policy prohibitting unlawful retaliation, and should train their supervisors to recognize actions which could be considered retaliatory.
