How do EEOC investigators decide whether your company has violated the laws they administer? One of their most important tools is a group of agency instructions and illustrations compiled in the EEOC's "Compliance Manual." Therefore, employers who wish to understand the EEOC's interpretation of these laws should consult the most current releases of the applicable portions of the Compliance Manual.
The EEOC is in the process of revising the Compliance Manual, and recently released two chapters which will be of interest to many employers. One, titled Compensation Discrimination, provides a detailed framework for identifying compensation practices that violate Title VII, the ADEA, the ADA, and the Equal Pay Act. The other, titled Employee Benefits, explains how the EEOC will analyze claims that employee benefit plans or practices violate Title VII, the ADEA, and the ADA.
